It can only proceed if one party is eligible to keep the flat under the divorce rules. If the Minimum Occupation Period is not met and neither party qualifies to retain it (for example, by having child custody or meeting the Single Singapore Citizen criteria if applicable), the flat may have to be returned to HDB, subject to approval.
