When a person passes on, properties under their name will be passed to their successors. If there is no will, assets will be distributed according to the Intestate Succession Act. Here are the rules for intestate succession:
1. If there is a surviving spouse but no parents or children, the spouse inherits 100%.
2. If there is a surviving spouse and children (with or without parents), the spouse inherits 50% and the children inherit 50%.
3. If there is a surviving spouse and parents (but no children), the spouse inherits 50% and the parents inherit 50%.
4. If there are surviving parents but no spouse or children, the parents inherit 100%.
For Muslim estates, the estate must be distributed in accordance with Islamic inheritance laws. Beneficiaries must apply to the President of the Syariah Court for an Inheritance Certificate to establish the share of each beneficiary. Muslims can only dispose of or give away 1/3 of their estate to persons who are not already entitled under the Inheritance Certificate.
